Q.No.1. What remedies are available to candidates against any decision of FPSC?

Ans. A candidate aggrieved by any decision of the FPSC has the right of representation and a review Petition under section 7(3) (a) and (b) of FPSC Ordinance, 1977 reproduced below: (3)(a) A candidate aggrieved by any decision of the Federal Public Service Commission may, within thirty days of such decision, make a representation to the Commission and the Commission shall decide the representation within fifteen days after giving the candidate a reasonable opportunity of hearing. The decision of the Commission, subject to the result of review petition, shall be final. (b) A candidate aggrieved by the decision of the Commission made under paragraph (a) may, within fifteen days of the decision, submit a review petition to the Commission and the Commission shall decide the review petition within thirty days under intimation to the petitioner.”

Q.No.2. If a candidate is not satisfied with decision of the Commission on his/her review petition, can he/she approach a court of law?

Ans. Yes. Candidates aggrieved by a decision of the Commission on his/her review petition can file an appeal to the High Court under section 7(3) (d) of FPSC Ordinance, 1977, reproduced below: “(d) Any candidate aggrieved by a decision of the Commission under paragraph (b) may, within thirty days of the decision, prefer an appeal to the High Court”.

Q.No.3. Can a candidate file a suit in Lower Courts or Federal Service Tribunal against FPSC’s decision?

Ans. No. A Candidate can not invoke the jurisdiction of Lower Courts or Federal Service Tribunal in view of bar contained in section 7(3) (d) of FPSC Ordinance, 1977.

Q.No.4. Can intending lawyers make request to FPSC for placing them on FPSC panel?

Ans. FPSC have no panel of lawyers/counsels. Services of lawyers/counsel are provided/approved by the Law, Justice and Human Rights Division.

Q.No.5. Can a candidate, intending to file a suit against FPSC, approach FPSC for some documents?

Ans. No. FPSC does not provide any document to candidates who are filing or have filed a petition/appeal against FPSC.

Q.No.6. Can a candidate approach the Commission’s Officers, Secretary, Members or Chairman for re-redressal of his grievances after rejection of representation and or review petition as per law?

Ans. Not permissible under the law/rules.

Q.No.7. If a candidate is not satisfied with a decision of the Commission, can he approach the Wafaqi Mohtasib (Ombudsman)?

Ans. No, FPSC, its functions, recommendations and all matters connected therewith are out of operation and purview of the Wafaqi Mohtasib (Ombudsman) in terms of SRO 82 (i) /95, dated 22.01.1995.

Q.No.8. What are the contents of SRO 82 (I) /95, dated 22.01.1995?

Ans. SRO.82 (I) 95: In exercise of the powers, conferred by clause (3) of Ariticle-31 of the Establishment of the office of Wafaqi Mohtasib (Ombudsman) Order, 1983 (PO.No.1 of 1983), the President is pleased to direct that the Federal Public Service Commission, its functions, recommendation and all matters connected therewith or incident thereto shall stand excluded from the operation and purview of the aforesaid President Order (No.D-1812’94.Law).

Q.No.9. Whether Islamabad High Court is dealing appeal cases filed against, FPSC ?.

Ans. Yes, All cases of Lahore High Court, Rawalpindi Bench, Rawalpindi have been transferred to Islamabad High Court,(IHC),G-10, Mauve Area, Islamabad.
